Terms of service

These terms are the agreement between you and Up. They are short on purpose: what the service is, what we expect from you, and what we do not promise.

  1. Accepting these terms

    By creating an account or using upcoach.app, you accept these terms and the privacy policy. If you do not agree with them, do not use Up.

  2. Who can use Up

    You must be at least 16 years old and able to enter into a contract. You are responsible for your credentials and for everything done through your account. Tell us promptly if you suspect someone else has access to it.

  3. What Up is — and is not

    Up is a coaching tool. It reads conversations you give it and returns observations, evidence and suggestions, so you can try something different next time.

    Up is not a surveillance system, not a performance evaluation system, and not professional advice — legal, medical, psychological, financial or employment. Do not use its output as the basis of a hiring, firing, promotion or disciplinary decision about another person.

  4. Your content, and consent to record

    You keep ownership of everything you upload. You grant us only the licence we need to run the service for you: to store, process and analyse your content in order to produce your feedback and show it back to you.

    You are responsible for having the right to upload what you upload. Recording and transcription laws differ by jurisdiction, and many require the consent of every participant. Before uploading a conversation, make sure you have the consent or legal basis required where it took place, and that any confidentiality obligation you are under allows it.

  5. Acceptable use

    You agree not to:

    • upload conversations you have no right to share, or content that is unlawful or infringes someone's rights;
    • use Up to monitor, score or evaluate another person without their knowledge and consent;
    • try to reach another user's data, probe or bypass our security, or interfere with the service;
    • scrape, resell or redistribute the service or its output as your own product;
    • use the service to produce harassing, discriminatory or otherwise abusive content.
  6. What the analysis is worth

    Analyses are generated by language models. They are grounded in the transcript you provided and cite evidence from it, but they can still be incomplete, mistaken, or wrong about tone and context. Treat them as a prompt for your own judgement, not as fact. The decisions you make after reading them are yours.

  7. Availability and changes

    Up is under active development. Features can change, and we may add, modify or discontinue parts of the service. We aim to keep it available, but we do not promise uninterrupted or error-free operation, and we may suspend access for maintenance or security.

    Where the service is offered free of charge or as early access, it is provided as is. If we introduce paid plans, we will state prices and terms before you are charged.

  8. Our intellectual property

    The service — its software, design, brand and content — belongs to us. These terms give you a personal, non-exclusive, non-transferable right to use it, and nothing more.

  9. Ending it

    You can stop using Up and delete your data at any time. We may suspend or close an account that breaks these terms, or that we are legally required to close. When an account closes, access ends and the content attached to it is deleted as described in the privacy policy.

  10. Disclaimers and liability

    To the maximum extent the law allows, Up is provided without warranties of any kind, express or implied, including fitness for a particular purpose.

    To the maximum extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost profits, revenue, data or opportunities. Nothing here excludes liability that cannot legally be excluded, including for fraud or wilful misconduct.

  11. Governing law

    These terms are governed by the laws of the Argentine Republic, and any dispute will be submitted to the ordinary courts of the City of Buenos Aires — without prejudice to any mandatory consumer protection that applies where you live.

  12. Changes to these terms

    We may update these terms. The date at the top always says when. For material changes we will give notice in the product or by email; using Up after they take effect means you accept them.
